Great Theory online tuition

These Terms explain how Great Theory’s online tuition works and what you and we can expect from each other. Please read them before you book a block of lessons.

In these Terms, “Great Theory”, “we” and “us” mean Nikodem Rajpold trading as Great Theory, 11 Cleevedale Place, London SW4 9FJ, United Kingdom. “You” means the parent or guardian who books and pays for tuition.

1.About Great Theory

Great Theory is an online Maths tutoring service operated by Nikodem Rajpold trading as Great Theory.

These Terms apply when a parent or guardian buys tuition from Great Theory. The parent or guardian who books and pays for tuition is our customer under the contract, even though the lessons are delivered to the student.

2.Registering interest

Registering interest is free and does not oblige you to buy tuition. Submitting the registration form does not, by itself, create a paid tuition contract.

We use the information you give us to find students who are compatible on:

  • level and programme;
  • availability;
  • group requirements.

If a suitable group can be formed, we will contact you with a proposed weekly lesson time and the details of the block.

We cannot guarantee that a suitable group will be available straight away.

3.Groups and lessons

Tuition is normally delivered online in small groups of 3–6 students. A standard block is six weekly lessons of approximately 60 minutes each.

Before you pay, we will confirm:

  • the start date;
  • the weekly day and time;
  • the programme;
  • the price of the block.

We may agree a different arrangement with you in writing.

Lessons are live and interactive. They are not routinely recorded.

4.Price and payment

Our current standard price is £18 per lesson, or £108 for a standard six-lesson block. The price that applies to your booking will always be shown or communicated to you before you pay.

Registering interest is free, and no payment is due simply because you have registered interest. Payment only becomes due once we have proposed and confirmed a suitable group and slot and invited you to book it.

A tuition contract is formed when:

  1. you accept the confirmed block;
  2. your payment is successfully received; and
  3. we confirm your booking.

There is no automatic renewal. Each new block needs to be agreed and paid for separately, unless you and we expressly agree otherwise.

5.Minimum group size

We normally form a group once at least three compatible students are available.

If a proposed group cannot go ahead before its first lesson, we may offer you:

  • another suitable group;
  • a revised start date; or
  • a full refund of any amount you have already paid.

You do not have to accept a materially different proposed schedule.

6.Your 14-day cancellation right

Where you enter into a tuition contract online, you normally have a legal right to cancel it within 14 days of the date the contract is formed. You do not need to give a reason.

To cancel, email nikodem.rajpold@gmail.com. You can use the optional form at the end of these Terms, but you do not have to.

If your lessons are not due to begin until after the 14-day period and you cancel within it, you will receive a full refund.

If you ask us to begin providing tuition during the 14-day cancellation period:

  • we may begin the lessons before the cancellation period has ended;
  • if you then cancel within that period, you only need to pay for the tuition provided up to the time you cancel;
  • we will refund the remaining amount.

Where this applies, we will ask you expressly, when you book and pay, whether you want tuition to start within the 14-day period.

Nothing in these Terms limits your legal cancellation rights.

7.Cancelling after the 14-day period

You may withdraw the student from the rest of a block by emailing us. We will refund the fees you have paid for future lessons that have not yet taken place.

Lessons that have already taken place, or that the student missed before you told us about the withdrawal, are not refundable.

This cancellation policy does not affect any stronger legal rights you may have.

8.Missed lessons

Because lessons are delivered to a scheduled group, a student’s individual absence does not normally entitle you to a refund or a replacement lesson.

Where practical, we may provide:

  • lesson materials;
  • questions;
  • notes;
  • guidance on the work missed.

This is not guaranteed to include a separate replacement lesson. We do not routinely record group lessons.

9.If we cancel a lesson

If we have to cancel a lesson, we will normally:

  • rearrange the lesson;
  • give you a credit; or
  • refund the affected lesson.

You will not be charged for tuition we do not provide. If we end an entire block early, we will refund the fees for any lessons not supplied.

10.Technology

Lessons are delivered online. You and the student are responsible for having:

  • a suitable device;
  • reliable internet access;
  • working audio;
  • an appropriate place to take part.

If a lesson cannot reasonably take place because of a technical failure on our side, we will treat it in the same way as a lesson we cancel (see section 9).

A technical problem solely on the student’s side does not automatically give a right to a refund, although we will act reasonably where we can.

11.Student participation and behaviour

Students are expected to behave respectfully towards the tutor and other students.

We may step in where a student’s behaviour seriously or repeatedly disrupts lessons, or affects another student’s safety or ability to learn. Unless immediate action is reasonably necessary because the behaviour is serious, we will normally raise the issue with you first.

If we have to end a student’s participation, we will normally refund the fees for future lessons not supplied.

12.Parent and guardian responsibility

By booking tuition, you confirm that you are the student’s parent or guardian, or are otherwise authorised to arrange tuition for them.

You are responsible for giving us the accurate information we need to arrange the tuition.

We will normally communicate with you, as the parent or guardian, about bookings, payments, scheduling and any significant concerns.

13.Teaching materials

Worksheets, notes and other materials we supply are for the student’s personal educational use. They must not be sold, uploaded publicly or redistributed commercially without our permission.

This does not prevent ordinary personal study, printing or note-taking.

14.Academic outcomes

We will provide tuition with reasonable care and skill.

However, exam grades, school assessments, university admissions and other academic outcomes depend on many factors outside our control. No particular result is guaranteed.

15.Our responsibility to you

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by negligence, and for fraud.

Nothing in these Terms affects your legal rights as a consumer.

We are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or failing to use reasonable care and skill. We are not responsible for loss or damage that was not reasonably foreseeable when the contract was formed.

The tuition is supplied for private educational use, so we are not responsible for any business losses.

16.Privacy

We handle personal information in accordance with our Privacy & Cookies Notice.

17.Changes to these Terms

We may update these Terms for future bookings.

The Terms that apply to a confirmed block are the version provided or agreed when that block was booked, unless a change is required by law or you expressly agree to it.

18.Complaints

If something isn’t right, please contact us first at nikodem.rajpold@gmail.com. We will try to resolve your concern promptly and reasonably.

19.Governing law

These Terms are governed by the law of England and Wales.

If you live elsewhere in the United Kingdom, this does not take away any mandatory consumer protections, or any right to bring proceedings, that you have under the consumer law that applies to you.

20.Optional cancellation form

You do not have to use this form. An unambiguous email telling us that you wish to cancel is enough.
